HELP WHEN IT'S HARD

In debt? Facing a legal problem? Start here.

People under financial or legal pressure often feel there are only two choices: give in, or fight alone. There are almost always more options — and free official help exists that many people never hear about. This page explains the ground in plain terms and shows where to go.

WHO THIS IS FOR

Different problems. The same first step.

01

Property owners under debt pressure

If a mortgage, loan, receiver or court action is hanging over your home, land or building, the worst outcomes usually happen when nothing is decided. Understanding the options early is what protects you.

02

People stuck in probate

When someone dies, the estate can sit frozen for months or years — debts to settle, property nobody can sell, relatives in disagreement. Mediation and a clear plan often move what a courtroom cannot.

03

Anyone worried about their rights

Whether it is a contract, a will, a boundary or a debt, you have rights and protections — under the Constitution, under statute and under general law. The first step is knowing where to look and who to ask.

YOUR RIGHTS AND PROTECTIONS

What everyone should know.

01

Your property rights

The Constitution protects property rights, but they are not unlimited — debts can be enforced against property through the courts. Knowing exactly who can claim what, and on what basis, comes before any decision.

02

Fair procedures

Before anyone takes your property or money through the courts, you are entitled to fair procedures: proper notice, a chance to respond, and a hearing. Missing letters and missed deadlines are where people lose ground.

03

Access to the courts

You are entitled to a hearing before an independent judge. Court action is not always the best route — but knowing it exists is what keeps negotiations honest.

04

Independent advice

Nobody should sign, sell, agree or settle under pressure. You are always entitled to take independent advice from a solicitor, and for major decisions you usually should.

05

Deadlines and limitation periods

Rights do not last forever — claims, defences and appeals all have time limits. If something feels urgent, it usually is. Find out the deadline before anything else.

06

Debt protections

Ireland has formal debt settlement and personal insolvency processes designed to protect people, not just creditors. They exist for situations exactly like yours.

This is general information, not legal, financial or tax advice. Every situation is different and laws change. For anything that matters to you personally, speak to a solicitor, a MABS money adviser or another qualified professional.

WHERE A PROPERTY PARTNERSHIP FITS

When the problem is property.

01

Understand what you actually own

Before any decision, it pays to know what the property or estate is worth and what could be done with it. Our free site check gives you an instant, plain-language brief on the development potential of a site — at no cost, with no obligation.

02

A property under pressure

If debt is forcing a sale, you still have options: sell as it is, get planning permission first and then sell, or partner with us and share in the development instead. Every site is different — the comparison page sets out how each route works.

03

Probate mediation

Estates frozen by disagreement, missing documents or creditor claims can often be untangled around a table rather than in a courtroom. We assist with probate mediation, working with our solicitors, and every arrangement is agreed individually and in writing.

04

Signposting, never advice

This page explains things in general terms only. I am not a solicitor and nothing here is legal, financial or tax advice. Where a matter needs a solicitor, we say so — and if you want, we can point you towards the right kind of help.

Any partnership, sale or mediation arrangement is agreed individually, in writing, after independent advice on both sides. Planning permission, outcomes and financial results are never guaranteed, and this page is not an offer of any kind.

A property at the centre of it?

If your situation involves land, a building or an estate, start with the free site check or tell us about it — confidentially, with no obligation.
